Yup, I just received a cease and desist. Unbelievable. Here is the money quote:
While the Yankees are very appreciative of their loyal and highly valued fan support,
unauthorized use of the Yankees Marks that would be confusing or misleading to the public, or
falsely imply some endorsement or sponsorship by the Yankees, cannot be tolerated. Although
the Website purports to be a “blog about Major League Baseball and the New York Yankees,” it
has clearly branded itself throughout with the Yankees Marks, including the Logo. Thus, you are
not using the Yankees Marks in a permissible manner but rather to brand your own online
service, and to create or imply a false impression that the Yankees have approved, condoned or
sponsored the Website.Your unauthorized uses of the MLB Marks on the Website and in the Domain Name are
likely to cause confusion, mistake and deception as to the existence of an affiliation, connection
or association between your business on the one hand, and MLBAM, and/or other applicable
MLB Entities on the other, and constitute trademark infringement, dilution and unfair
competition in violation of federal and state law.Accordingly, demand is hereby made that you immediately cease and desist from using
the YANKEE UNIVERSE name and the Logo, any other Yankees Mark and any other MLB
Mark in and as the name of your Website, to promote the Website, to seek advertising any other
commercial opportunities, in and as the Domain Name, and in any other manner that would
cause consumer confusion, dilution of the MLB Marks, or imply any sponsorship or

Dudes, this is total BS. They don’t send ESPN C&D letters for having Yankees logos on the team home page, do they? If you have to get rid of the navicon, so be it, but this is just them being bullies — fight them! I have some experience and knowledge of trademark matters and I really don’t think this passes the smell test.

Sadly, the Yankees have to do this to protect the integrity of their trademark. While there is no ill will through its use here, the use inescapably dilutes the Yankee trademark. If the team hopes to protect its rights against other users (counterfeiters, etc….) it must preserve the integrity of its trademark and show any future “user” that they have not abandoned their rights. I’m sure its not malicious, but it is a requirement. If you want an example, a few years ago Metallica had to go after some makeup manufacturer that put out a makeup line. “Don’t use it, you lose it.”
The difference between use by ESPN and here is that ESPN gets a “newsworthiness” exemption and also probably has a deal w/ MLB, to which the Yankees belong.
This is absolutely true. EJ and the other writers on this blog, take note. If MLB sits on your infringement (as benign as it is), some future malignant infringer (someone who is, let’s say, profiting off of the goodwill created by the Yankees marks) can claim that MLB abandoned the mark by failing to protect it.
Fight what you can and push back with good PR – I’d also look into getting them to license your use of the marks, since you’re not actually using the marks for commercial purposes. Or you could change the nature of the site to writing posts criticizing the Yanks and then claim fair use via parody (note: don’t do that, I’m half-kidding).

While this is BS and as the Poster God has mentioned there is a newsworthy exception to using names and likeness and you could probably fight it and maybe win with some sort of comprimise (removing logo and a disclaimer) and also cause the yanks bad publicity by calling some NY Post reporters, in the end it comes down to is it worth the hassle and expense (I don’t reccomend fighting this solo you really need someone who is an expert in this field and that means $$$). My suggestion is call the lawyer who sent the letter and see if there is any sort of compromise that can be reached. If they take a hard line then I like the suggestion of Mo’s Cutter. Just be sure to keep us updated. Best of Luck.

That being said, I also hate MLB’s overreaching in this manner and accordingly wish to assist you in the following manner:
1. GET RID OF THE LOGO icon. NOW. There is no argument on this point.
2. Once you have done that, you are no longer using the Yankees’ “marks.” Feel free to write back and remind them of same.
3. The name “Yankee Universe” is not a protected mark. Those two words together without any logo or mark are not causing confusion and properly worded disclaimer will suffice.
4. Even if you decide to not fight and simply bow under the weight of MLB’s undue pressure and change the name of the blog, under no circumstances should you give up the URL for less than six figures.
Note that you shouldn’t solicit an offer but if asked you can indicate no transfer of ownership will be made without just compensation.

One thing- Yankees Universe is a protected, registered mark. Does that change anything?
Yes it does. “Yankee Universe” is similar enough to “Yankees Universe” for a court to find dilution. The Second Circuit, for instance, has found “Charbucks” similar enough to the name of a certain other coffee chain to sustain a claim of dilution.
+1 for the dollar sign, though. That’s a nice touch.
EJ also tells me that MLB asked that you no longer use photo-likenesses of Yankee Stadium. That is overreaching. You should continue to use those photos if you’d like, though like I told him, they may have some sort of protection over the classic “facade” image. But I don’t see that image anywhere on your site.

Note that MLB simply stated that “Yankee Stadium” is one of the trademarks that they want removed from the site. We assume that they are referring to our banner.
There are plenty of Yankee Stadium images freely available for commercial use under the creative commons license. So images of the old — and new — Stadium should not be an issue.
You can also consider cloaking the domain, and using java images instead of HTML. In the event you decide to use a new domain name, I would strongly urge to have a write-in contest and plenty of PR. Remember, ANY PR is good PR.
To paraphrase the words of Senator Blutarsky, “This could be the greatest night of your lives…” You could generate enormous mileage from this event. Don’t blow it.

Yankee Candle doesn’t exist in commerce as something relating to baseball. The Yankees’ trademark protections for Yankees covers products in commerce as they relate to baseball. Yankee Candle is a two-word mark that covers “the fields of candles and candle accessories, housewares, glassware, tableware, personal care products, home fragrance products and clothing,” per its TM registration.

This is a really important distinction. MLBAM is owned by Major League Baseball, not the Yankees. So to criticize the Yanks for this is really unfair, they had nothing to do with it (that we know of).
Trust me on this one: the request came from the Yankees. BAM is the internet arm of Major League Baseball. It operates because the 30 clubs and the Commissioner’s Office granted it the rights to all online marks. With it that comes some oversight, and the Yankees did indeed ask BAM to enforce their trademark in the domain name and their copyrights in the marks.
You can pretend the Yankees are the good guys and BAM the bad guys, but they’re just doing their jobs. You guys are the ones using a domain name of a registered trademark!

Yes – the Yankees likely can go after you for using Yankees and Universe in a blog (and the logo was clearly a mistake). But do they REALLY have to go to this extreme? Even if they think that they need to go after unapproved users of their trademark, they can always give you approval. Paramount gave approval to the homemade Star Trek movies, for example.
The more I think about this, the more that I think that it is just an extremely petty decision made by someone in Yankeeland.

Do you guys realize Yankees Universe is a charity that supports programs for kids with cancer at Memorial Sloan-Kettering Cancer Center? If I were you, I wouldn’t push this further and wouldn’t look for more pr. You will not only lose the legal battle, you’ll also lose the pr war. Even if you didn’t know it at first, you are using the name of a CHARITY. I guarantee you the Yankees will pitch this as a battle between you and a charity that helps kids with cancer. Do you really want that fight? Put up a new name and move on. We’ll keep reading.
Yeah, here is the problem with that- the charity was around for a while (although I did not know this when I picked the name) and they took no issue with our site. We take exactly zero dollars from the charity, nor do we profit off the site. We have exactly one paying ad that covers our hosting cost and that is it.
We are also willing to provide free advertising for the charity on our site.

And since there is no malice or intent to pass off any goodwill from the Yankee logo as your own simply by having “The Yankee Universe” as your domain name – you aren’t a cybersquatter under the ACPA. This is a “legitimate” website with no intent to extort from the Yankees (I can only presume).

It’s absolutely absurd that ‘Yankee Universe’ can be trademarked.
English words, and simple combinations of two English words, should not be able to be trademarked.
Most of the people leaving messages evidentally don’t choose to understand that the website name is close to the charity’s name. What do you want Moshe to do, rename the site http://www.redcross.com? That would go over really smooth.

This would never get to court and frankly the magistrate would “strongly” recommend an out of court settlement.
Most people in the US are terrified of getting a letter from an attorney but even more terrified of hiring an attorney.
I can assure you that the ACLU and other very well qualified attorneys would be more than happy to do this case “pro bono.”
This also gets into the arena of internet law – which is very much different than traditional law.

I thought “Yankee Universe” was a descriptive term coined by the media(?) some years ago to describe the Yankee fan base. I thought it’s use began about the same time Red Sox fans began calling themselves the Red Sox Nation? I’d be curious to know who actually first used the term Yankee Universe and when it was first used. It seems to me it was used long before the Yankees used it on their charity.
Trademark rights are about protecting the public against likelihood of confusion. Is it likely that consumers of each parties service, namely, those giving to charity and those reading baseball blogs, will confuse the use of similar terms, Yankee Universe on a baseball blog and Yankees Universe on a charity? Or are those consumers likely to think they both originate from the same source? I don’t think so. And, when you’re out on the street and someone walks by with a t-shirt emblazoned with “Yankees Universe” do you really think it originated with the Yankee charity or this blog? I doubt it. You think….hmmm, a Yankee fan, don’t you?
A question I have is do the Yankees really have trademark rights to the term Yankees Universe outside of its use in connection with the charity? To me, Yankee Universe and Yankees Universe are just descriptive terms routinely used by the media and fans to describe the Yankees fan base…. Yankees Universe seems synonymous with saying Yankee Fans…JMHO.

You shouldn’t worry. I doubt the Yankees would spend the money to fight you. In copyright law one of the most most important things to do is to protect your brand. If your brand because too common you can no longer get money for it. There are somethings you need to be aware of.
Likelihood of Confusion.
Courts do not take kindly to the use of trademarks by others for profit. The courts will look to see if your site can be found to be actually associated with the professional team. Which leads us to
likelihood of Dilution.
Because your website uses their mark is there brand negatively effected? Are you making it harder for them to do business?

One more thing, from what I’ve seen Yankees Universe is not a charity. It is a fan club run by the Yankees and the Yankees donate a portion of its proceeds to support the Department of Pediatrics at Memorial Sloan-Kettering Cancer Center research and treatment initiatives for children with cancer.
hope they sue you, they could really use the publicity of bludgeoning a loyal fan who is only trying to support them and show team spirit.
